Question by : Suit or Judgement on a repossessed car?
I purchased a car for a friend and do to some unforeseen occurrences she could no longer make payments on the car. I informed her to turn the car in and she did as I myself was not able to make the payments for her. After this time I received a notice from the creditor that the car was in there possession and that it may be sold in a private or public auction or sale. I then received a notice from the credit reporting agency equifax that a suit or judgment has been added to my credit report; when i checked it out it was from the credit union that financed the car the friend had voluntarily turned. So what I would like to know at this point is: 1. what does a suit or judgment mean on my credit report, especially for a account that was given a status of a charge off? 2.How do I find out if in fact I am being sued and what I can do? 3. Can I be placed in jail if i cannot pay or can they take my car that i purchased from another dealership and am currently paying for?
I live in Texas, there is no judgment made on the case yet becuause i haven’t been served no – notice in the mail or in person. Hope this will help make things easier to answer the question.

If the judgment shows on your report you have already been sued and lost. Most likely because you failed to show up for the court date.

Now that they have this judgment, they can attach your bank accounts, garnish your wages (if your State allows it) and file liens on any other real property you may own like cars, boats, land and homes. They can not put you in jail or take your property, but neither can you sell any of the property that has a lien on it without paying the lien first.

Judgments show for either 7-years or until the statute of limitations expires whichever is longer and in some States can be renewed, depend on which State you live in this means that the judgment can show for up to 40-years.

You can petition the court and challenge the judgment saying the you were not properly served the court papers but since you did purchase the vehicle you will lose.

Additional information.
The good news is you live in TX so they can not garnish your wages, the bad news is if as you said the judgment shows on your credit report you have been sued, lost and the court has ordered a judgment weather you were served or not. This is the only way the judgment can legally show on your report.

I am in financial crisis.. I lived off of small paychecks most of my life, but in the last couple of years fell into a way better paying field of work in the refineries and made much more than the average person… With the extra compensation came extra bills, I was buying a nice newer truck from a joe schmoe used car lot, I decided I would buy some wheels from rent a wheel, knowing that I would have them payed off in less than a month… well does life have a funny way of playing games with people, my nice big new truck broke down, the car lot gave me the cold shoulder saying that it was my duty to repair the vehicle i had only had for 3 months, and I didn’t have the money at the exact moment that they told me this…. I was ahead in my payments on the truck and they still put it up for repossession… saying that my insurance had lapsed… which would not have been a problem except It was sitting at their shop when they did this. My wheels were on the truck.. they told me I couldn’t have them, I told them they belonged to rent a wheel, they weren’t mine, They said i would be arrested for trespassing if I went on the property, I was under the impression that I had 30 days before they could do anything with the vehicle, and waited a foolish week before letting rent a wheel knew what was going on, during which time, i Managed to basically lose my job struggling for a ride to work…. Rent a wheel contacted the car lot and they said they had auctioned the truck off only 10 days later, and the wheels were on it, and I had never made any attempt to get the wheels. It has been a couple of months, I missed some payments and they had me come into rent a wheel and renegotiate my terms, told me that I was facing 10 years imprisonment or 10,000 dollar fine minimum for theft of rental property…. said If i was one day late on one payment they would process all there papers, the re-agreement (“where they were trying to help me”) and everything to the courts. I am 2 payments behind today. I have no money to pay, times are very hard, bill collectors like talking to me. I owe rent and etc, I probably have 15,000 in debt and not even a mortgage or car loan right now…. I don’t know what to do, and I am not making enough money to hardly pay for the necessities, I want to pay my bills. I had good credit before all this…. I traded in a good car for the truck that was paid off, and i basically gave my other truck away to help a family member…. and now I don’t even have a good vehicle… Im about to just curl up in a hole and give up. Please someone with good advice, help me out..

I’m afraid there is no good answer here. Unfortunately, you made a lot of mistakes. The real issue was that when you got your new job, you made too many assumptions. You assumed that you would always have it. You assumed that you didn’t need to save for an emergency. So you went out and borrowed a bunch of money without a safety net. Sadly, that backfired when things didn’t go exactly as planned and here you are.

The reality is that you are going to be held responsible for the shortfall on the auction of the truck and the value of the wheels. I don’t think the rental place is going to have any luck in charging you with anything criminal. They would have to prove intent. Now that doesn’t mean that they will not sue you and win the value of the wheels plus their lost income. So You’re looking at some money you’re going to owe from both sources.

The only thing you can do is get the income up. You’re going to be harassed by bill collectors continuously and eventually sued. But that separate from working. Get another job so when they do call, you can work out a payment plan and/or settlement. There’s no way around that since you really do owe the money. This won’t be forever, but it’s where you are right now.
