My brothers vehicle was repossessed on a thursday when they did not receive his payment in time, the following monday they told him they already sent it to the Auction center. They told him they would email the auction people to get his car back but he would have to pay for any repairs they made on his car. Isn’t there a law that requires the company to give the consumer 30-60 days before they sell it? Doesn’t seem right after 2 business days there about to sell it and making him pay for the repairs they make if he gets it back?
No he was 3 months late and sent in 2 payments at once. But Im not worried about that part we know he was responsible with keeping up with the payments.

My issue is them taking the car to auction 3 days after they repod it. The fact if he wants it back he has to pay for the repairs they did to it to make it auction ready..
That is not true. There is a “Consumer Protection Law” in many states that require the loaner to give the consumer 30-60 days to retrieve their vehicle. Im trying to find out the details of Texas Consumer Protection..Sooo ya.. Your wrong…

Your car isn’t repossessed after missing just one payment. You have several months to make payments before they repossess it, so quibbling over how quickly they got the car to auction is pretty ridiculous.

ADD: Repossession is not yet another process to try and get you to pay. It’s about the creditor getting their money back. Once it is repossessed he has absolutely no claim to that car whatsoever. The repo company has no obligation to hold on to it for more than 1 minute after it is repossessed. They have no obligation to sell it back to him AT ALL, so if they choose to ask for repair costs he has the option to either agree or not get the car back.

I financed a 2001 Mustang convertible. Five year loan. The car was priced at $ 13,000, and the loan total was $ 33,000. Yes – a really cruddy, upsidedown loan.

I’ve made 40 payments (more than $ 20 grand), and there is still $ 10,695 outstanding on the note.

Last week, the car was repossessed. For reasons that I won’t bore you with, I can get the loan reinstated if I pay the payments I missed…. about $ 1,000 total, plus of course horrid fees for towing and storage.

My question is…. is this worth it? I’ll be paying the back payments that I owe, plus fees, and will STILL owe $ 10,695 on a car that now only has a Blue Book value of $ 7,200 or so. And has 82,000 miles on it.

My instincts are to let them auction it and make arrangements to pay the difference between what they get at auction and the $ 10,695 outstanding on the loan. My credit is ruined anyway, soooo…. am I better off to do this, rather than pay the money to reinstate?

If the vehicle has not already been reported as a repo? You might have a chance to reinstate the loan and trade it in on something else. You are only $ 3,500.00 upside down and believe it or not that is not a lot any more.

If you do reinstate the loan insist that they not report it as a reclaimed repossession because this will look almost as bad as a straight repo and will show on your credit for 7-years.

If you let it go back, you are going to end up with your credit being ruined and owing them several thousand dollars by the time they sell it for a lot less than it’s worth and then add all of the fees involved.
