Question by Emily G: I voluntarily had a car repossessed back in June and now they are taking me to court for the difference.?
The difference for what I owed and what they sold the car for is about $ 8,000.00. I contacted them at one point and asked them what the payments would be for them not to take it to court and the payments were basically what I was paying on the vehicle. I told them if I was able to pay that I would of kept the car and avoided all of this but obviously I couldn’t afford it that is why I called for them to come pick it up so what makes you think I can pay it now? I was never late on a payment, there was no damage to the car, they took it to auction and sold it for $ 21,000.00. The car just had 5,000miles on it. I received a letter in the mail from a lawyer group saying they could prevent it from going to court. Should I contact these people or just go to court and see what happens. I am a stay at home mother with my two children 3 years & 7 months, and my husband is the only provider. I would just like to know what the outcome may be if we go in front of a judge. Between our bills,groceries, and gas for our cars there is no extra. Will the courts attempt to get blood from a turnip?

Answer by HD yes, contact the attorney and at least see why they have to say, you’ve got nothing to lose. and yes, they will try to get blood from a turnip. you should be able to work out a reasonable repayment plan.

i need to see them on the website like they have to be repossessed by the bank or impounded cars for sale, i heard they have brand new bmw’s for like 20,000

Question by need to get back on my feet: I CANT make CAR PAYMENTS. how do i get rid of this car?
i have a car and i own about 4% of it. i cant make monthly payments. i dont want my car to be repossessed because i would have to pay the difference when the car is being auctioned off. i cant surrender the car because i am trying very hard to raise my credit score. i have been raising my credit score for about 1 year. i dont know how to get rid of this car, i cant trade it in because i still would have to pay the difference and pay for another car. what should i do? please help?

Answer by e I would contact the people you have your loan with. Explain your situation and ask if you can have a lower interest rate, or renegotiate a lower payment. These are tough times, and most companies would rather you pay less but at least pay than have to fight to get their property and/or money back. If you are in the military you can usually get most of your loans lowered to 6% interest rate, just ask. You said you are trying to raise your credit score, so perhaps you’d qualify for a better rate now. Or shop around and find someone that offers a better rate. The worst they can say is no. Or you could always try insurance fraud… but I didn’t recommend THAT.

The car was repossessed 7 months ago, and then they filed a suit for the difference a month ago. Is there any way to prove that what they did, taking it to a dealers auction wasnt legal, or something like that? The cars owners may have to go bankrupt if this isnt resolved. Thing is, if you could have paid in the first place, you would still have the car! So, how is it now legal for them to sue for the difference? Can they put a lien on your home? and if they do, can they make you sell it? THIS one thing may cause them to file and they dont want to.

Answer by GIOSTORMUSN Simple answer, yes it’s legal. The clause is actually part of the loan contract. They are probably going after the difference since the car was sold at auction below the total balance amount. The only thing that they can try to do is come to an agreement for repayment with the company currently holding the loan contract. Since the vehicle was repossessed it will show up in their credit as a repossession.
